PlanIt 3D - Terms of Service
ACKNOWLEDGMENT AND ACCEPTANCE OF TERMS OF SERVICE
PlanIt 3D is operated under the Terms Of Service contained in this document (referred to as "Terms Of Service"). By completing the registration, sign-up form, and/or by the use of this site, you are indicating your agreement to be bound by all of the terms and conditions set forth below.
Description of Service:
PlanIt 3D’s mission is to provide members of the CG graphics community
with a friendly environment that promotes collaboration and knowledge
sharing between community members. By providing forums, private
messaging, galleries and similar functionality PlanIt 3D enables
members to communicate ideas, provide advise, contact other artists
and publish work for comment or review all as a free service.
PlanIt 3D’s Site Staff and Moderators have created the following
Terms of Service agreement that governs members’ participation
and practices within PlanIt 3D. As a member/user of PlanIt 3D, it
is your responsibility to know, and adhere to the Terms of Service.
Member/User Conduct:
Members and users are expected to conduct themselves in a manner
that is constructive and respectful of others at all times. You
are solely responsible for the content of information you publish
or display ("post") on the site or transmit to other Members.
You will not post or transmit to other Members or to any Forums,
Galleries, or any other portion of the site any item that is defamatory,
inaccurate, abusive, obscene, profane, offensive sexually oriented,
threatening, harassing, racially offensive or illegal, or any material
that infringes or violates another's rights (including but not limited
to intellectual property rights and rights of privacy and publicity).
Member Obligations:
You are solely responsible for the content of information you publish
or display ("post") on the site or transmit to other Members.
You will not post or transmit to other Members or to any Forums,
Galleries, or any other portion of the site any item that is defamatory,
inaccurate, abusive, obscene, profane, offensive sexually oriented,
threatening, harassing, racially offensive or illegal, or any material
that infringes or violates another's rights (including but not limited
to intellectual property rights and rights of privacy and publicity).
Posting of nude photographs is strictly prohibited in the Forums.
Personal attacks on current or past members, vendors, administrators,
moderators, or other web sites is strictly prohibited. PlanIt 3D
reserves the right, but has no obligation, to reject any "items"
it deems unacceptable. You will not be involved in transmitting
or posting any junk e-mail or copyrighted material(s). Any activity
which results in a denial of service to other Members such as using
off-line readers to cache the entire site is prohibited. Your usage
of PlanIt 3D must be in a manner consistent with all applicable
International laws and regulations.
Members/Users
will not use this community for:
Any practices that affect the normal operations of the community
(Site Staff will take whatever steps are necessary to restore service).
Transmitting any libelous, defamatory, or any other material that
could give rise to any civil or criminal liability under the law.
Personal attacks. This includes but is not limited to, destructive,
abusive, defamatory communications in any form, and retaliatory
attacks.
Destructive commentary/communications made with the intent to disrupt
or attack. This applies to any communications within this community,
whether in the forums, galleries, private messaging.
Advertising or linking to any publications and/or web sites that
are age restricted due to content, and/or pornographic in nature.
Posting Unacceptable Images or Writing Themes:
No Rape [actual or implied]
No Torture [defined as: the infliction of intense pain (as from
burning, crushing, wounding, crucifixion) to punish, coerce, or
afford sadistic pleasure]
No Sexual acts [no depiction's of sexual intercourse - between humanoids/non-humanoids/animals
- no masturbation]
No Physical arousal [This includes but is not exclusive to: no images
of an erect penis/ no images showing the inner portion of the vulva
or vaginal area]
No Explicit sexual content [No manipulation of breasts/nipples/
no sexual situations/ no “implied” sexual acts/ no extreme
or explicit S&M bondage situations/ no lewd or obscene sexual
references]
No Genital contact with ANY object, other than sitting or clothing.
No depiction's of young humanoid characters/children giving the
appearance of being under the age of 18 where genitals are displayed
and/or in erotic, seductive, provocative poses or context. Since
age is difficult to identify with 3D images, this will be at the
discretion of the PlanIt 3D team.
No character attacks, which could be interpreted as defamation of
character, slander, and libelous.
Additionally, any post, image or writings can be removed at the
discretion of staff and moderators if it is deemed unsuitable for
this community. Conversely there may be some images that, whilst
in apparent violation of the rules, will be permitted to stay in
the interests of artistic expression, free speech and religious
tolerance. In such cases the artist may be asked to provide reasons
why the image should be permitted to stay or asked to make minor
modifications the decision of the PlanIt 3D staff in these situations
will be final.
Members/Users found practicing unacceptable behaviors receive.
Deletion of
posts.
·First event – Private Message - Explanation of TOS
and where the user has not adhered to this.
·Second event – Private Message / E-mail– Explanation
and first warning
·Third event – Private Message / E-mail - Final warning
·Fourth event – Membership canceled, and access to the
community permanently blocked. PlanIt 3D considers members information
private and confidential. However in extreme cases PlanIt 3D will
refer users behavior to the appropriate legal authorities, and if
appropriate charges may be filed.
Conduct - Zero Tolerance:
PlanIt 3D maintains a Zero Tolerance on certain behaviors within
the community. These include, but are not limited to the following.
·Any threats of physical harm, property damage or acts of
violence toward another individual, or group of individuals.
·Soliciting or Trading of any products illegally. This includes,
but is not limited to, requests and/or distribution of computer
software, software security overrides, serial numbers and/or admission
of use or possession (warez).
·Intentional practices that affect the normal operations
of the community
·Any member found to be impersonating a moderator or Site
Staff at PlanIt 3D or within another community will have his/her
membership canceled.
Members/Users found practicing these behaviors will immediately
have their membership canceled, and access to the community permanently
blocked. PlanIt 3D considers members information private and confidential.
However, there may be certain situations that necessitate otherwise.
The appropriate legal authorities will be contacted, and if appropriate
charges may be filed.
Intellectual Property
Copyright Policy (Please Read):
PlanIt 3D members remain the original copyright holder in all materials
(software and content) provided on the community. Use of the material
inconsistent with the terms and conditions set forth is prohibited
and considered an infringement of the copyrights of the respective
holders unless specially stated otherwise.
Communications
PlanIt 3D provides a variety of communication services to members.
These include but are not limited to: forums, galleries, private
messaging. PlanIt 3D will not be held responsible and/or liable
for information that members choose to share via these services.
We strongly recommend that members exercise forethought and caution
prior to disclosing any personal information while using these services.
Privacy Statement:
PlanIt 3D maintains a database of member/user information to facilitate
the community's operations for members, users and site staff. The
following discloses our information collection, use and dissemination
practices.
·E-mail Addresses: Member e-mail addresses are stored in
a database for use in distributing PlanIt 3D Newsletters. This information
is not shared except in cooperation with appropriate authorities
in the case of violations of our Zero Tolerance Conduct.
·IP addresses: Member/User IP addresses are collected, and
stored in a database to help diagnose, track, and manage issues
within the community. This information is not shared except in cooperation
with appropriate authorities in the case of violations of our Zero
Tolerance Conduct.
Indemnification:
You agree to indemnify and hold PlanIt 3D, its officers, directors,
employees, volunteers, subsidiaries, affiliates, successors and
assigns, harmless from any third party claim or demand, including
reasonable attorneys' fees, made in connection with or arising out
of your use of the Service, your violation of the Terms Of Service,
or the infringement by you, or other users of the Service using
your membership, of any intellectual property, right of privacy
or publicity, or other right of any person or entity.
Copyright:
It is PlanIt 3D's policy to protect the copyright of all members
posting material to this site. Any material posted to PlanIt 3D
remains the property of the poster, and they retain all copyrights.
By posting to PlanIt 3D, the poster warrants that they are the copyright
holder, or have permission or license to redistribute the material.
No further distribution is allowed without the express consent of
the poster.
If at any time the copyright of a posting is called into question,
the poster will be notified of the challenge. If this challenge
is made by the original creator of the material, it will be removed
as quickly as is reasonably possible. If made by a third party,
the poster will be given 48 hours to assert their right to post
the material. If no response is received within 48 hours, the posting
will be removed from the site until such time as the poster provides
sufficient evidence that they have been granted rights to reproduce
the material in question. Repeated posting of material that infringes
on someone else's copyright may result in termination of membership
at PlanIt 3D.
Termination/Cancellation:
PlanIt 3D may terminate the Service with or without cause at any
time and effective immediately. PlanIt 3D shall not be liable to
you or any third party for termination of Service. Should Member
object to any Terms Of Service of this service or any subsequent
modifications thereto or become dissatisfied with the Service in
any way, your sole and exclusive recourse is to immediately discontinue
your use of the Service and notify PlanIt 3D of your decision, your
membership will then be canceled. Upon termination of the Service,
your right to use the Service and Software immediately ceases and
PlanIt 3D shall have no obligation thereafter to forward any unread
or unsent messages to members or any third party.
Limitation
of Liability:
PlanIt 3D shall not be liable for any direct, indirect, incidental,
special or consequential damages, resulting from the use or the
inability to use the service or resulting from any assets downloaded
from, messages received or resulting from unauthorized access to
or alteration of Member's transmissions or data, including but not
limited to, damages for loss of profits, use, data or other intangible.
PlanIt 3D shall not be held responsible for any messages received
by Member, regardless of their content.
Modifications
to Terms of Service:
PlanIt 3D may change the Terms Of Service of service from time to
time. It is your responsibility to check this document periodically
for any changes or modifications as there will be no individual
notices to Members regarding such changes or modifications. Your
continued use of the Service constitutes an affirmative acknowledgment
by you of the Terms Of Service and any subsequent modifications
made to them and your agreement to abide and be bound by them.
